Chinese Wuhan Virus Thread

Karnataka police have arrested 60 more people in connection with the attack on health workers and destruction of government property in Padarayanpura area of the state capital of Bengaluru late on Sunday night.

All of them are being charged under the national disaster management act as well as the epidemic diseases act apart from various sections of the Indian Penal Code (IPC). With this, the total number of people detained has risen to 119.

The presence of foreign Jamaatis is the reason why there was violence in Bangalore. Hopefully the whole lot are jailed for a long time.

How many of you agree with this
I dont

Maharashtra 773 cases today..

Think this state needed to be handled separate ly henceforth.

Community transmission started?

But a file maker company messaged me, govt has allowed function ing of their company.. And they are going to manufacture at a lesser capacity than usual.

After Talbligi clusters, hope Maharashtra doesn't become next big hurdle...

Tamil Nadu seems to doing well..
53 new postive cases with 90 recovered..

Touchwood if cases are controlled,
Shouldlock the inter state buses and train service s..

And TN should become lead puller of economy.. All medical equipment industry flourish .. Selling for domestic and international needs..

Chennai's still going steady with ~15-50 cases every day or other day. For every district to reopen & start working, it needs to record no new cases for at least a week. Otherwise after May 3 too I guess lockdown will continue.

You actually have to wait 28 days after the last case to be very sure that the virus has been beaten.

Is this arrest legally tenable ?

I should be within my rights to refuse delivery citing recent cases of spitting and urination by muzzies on food stuff , isn't it ?

Any lawyers here who has a understanding ?

This is invasion of my fundamental rights isn't it ?

Yeah. It's legally tenable. He could get jail up to 3 years for religious discrimination.

Deliberate and malicious acts, intended to outrage religious feelings or any class by insulting its religion or religious beliefs.— Whoever, with deliberate and malicious intention of outraging the religious feelings of any class of citizens of India, by words, either spoken or written, or by signs or by visible representations or otherwise, insults or attempts to insult the religion or the religious beliefs of that class, shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both.

The guy was pretty foolish to not accept the groceries based on religion. If you don't trust the delivery guy, just take the order and then dump it. For a few hundred bucks, he ruined his life, or will possibly lose many times more money in bribes and lawyer fees. It's more than likely that the delivery guy did not actually spit or urinate on the groceries anyway. Some people are pretty stupid.

Different story that the Muslims have ruined their reputation completely. Even Muslims will not want to buy from Muslims anymore.

My last post on this issue

How is 295a applicable to the guy , he simply refused to take the order .

He didn't insult anybody or anything , the arrest is purely circumstantial by a overzealous police.

If tomorrow I refuse to buy from a M vendor , vegetables because I don't like the quantity , will the police have the grounds to arrest me under 295a.

Also how is it any different if I cancel order from a food delivery service after I realise the food was cooked in a M store ( where bxxf is cooked ) will the M plea that I discriminated against him on religious grounds hold true ?

The constitution, the police and the judiciary is a mess , I tell you . Laws are only for commie , mullahs and evangelists

He is charged with 295 A, which is causing deliberate hurt to religious feelings. This is cognizable, non bailable and non compoundable which means (roughly)-

Cognizable - Police officer can arrest without warrant and produce him to magistrate and judge will decide if the case can be made.
Non Bailable - He will not get bail outright but magistrate will decide on bail.
Non Compoundable - The affected party, the vendor in this can't pardon and settle the matter.

He will be well within his rights to refuse anything from anyone unless he use race, religion, caste or any other thing as ground for refusal. This make it discrimination. So refuse whatever you want just don't say things that will cause you trouble.

In this video he has not said anything (atleast not clearly audible) but affirmed when vendor accused him of religious grounds. He can present his side and those example you cited above to judge, try not to use religion instead confusion, panic, hygiene as grounds, stay regretful and he may walk home either on bail or without case. This case got media attention so magistrate may play safe and refuse bail.

Either way it's not too big a case to lose your sleep.
