Labour, Land Law and Tax Reforms : Updates

Minimum wage is applicable to establishments having 1000 employees. Don't you think any establishment employing 1000 workers will be big enough to pay wages that can barely keep the employee out of poverty?

It was a joke, a cruel one as governments themselves didn't obey it while hiring. For this one Act government has endangered whole ordinance as they will get a good dressing down in court room in coming days.
I don't think so. It's very cold calculations at work. The GoI or state govt's stand would be that this is a temporary measure ( 3 years) given the economic emergency we've in thanks to the pandemic we're undergoing & that this is one of the few ways the economy can be revived.

A few other clauses may be reviewed / altered by the courts to demonstrate their independence, as is to be expected but by & large all state governments implementing suspension of various labor laws can expect to carry their day in the courts. You could even say this is a political master stroke.

This country is officially a banana republic now. I expect a major social upheaval in future....condition were already pathetic with contractual jobs + poor and stagnant wages and working conditions. now you can hire and fire without any punitive action. corporate bosses and rich shareholders should rejoice while poor and workers should expect a hell for themselves and there families.

Gland that at least one CM is doing what was due for so long in my home state UP. People may call him religious gelato or whatever, but the fact is he has taken the responsibility of uplifting the social status of UPites and most importantly it’s poor farmers and labor class. Minimum wage and other labor laws are for Govt Babus and 99% of the times even govt avoids it by hiring on contractual basis. There is apparently no usefulness of these morally correct laws for poor farmers and labourers.
UP has huge population (even more than countries like Pakistan and Bangladesh). It is historically plagued by political mismanagement and vote bank politics, very similar to what was seen in Bihar before Nitish or MP before Shivraj.
We don’t need more laws , we needs jobs, a lot of jobs and we need them right now. There is huge unemployment in UP, which forces people to either work on agriculture fields as daily labourers or migrate to industrialised (yes the evil industrialists) states like Delhi/MH/Gujarat/KA/TN etc, where they have to work in squalid and hazardous environment at wages far lower than the MDW under contractual basis. This causes unsatisfaction and anxiety among migrant labourers.
Also poor people of these states hate them for taking up the jobs and lowering the wages due to imbalance in demand and supply equation.

Curret CM is focusing on bringing more industries to the UP. Since almost a year he is doing everything to woo industries like development of transport and electricity infrastructure ,quick land acquisition and dispute resolution and giving special incentives to factories setting up factories in designated industrial corridors.
If he succeeds in doing that, UP will no longer be reliant on other states to feed its people. UP is very fertile anyway and we don’t have much of water problem. So it can be one big semi industrialised state and can also act as Connection between Western hub(Delhi, Hariyana,Rajasthan) and Southern Hub (Ka/AP-TG/TN).

That said his method of working has some side effects too. For example he has given the Civil Administration power to bypass the local political leader, so much so that these politicians now a days feels alienated and have very less incentive to forward the project files and development works( less chances of bribery). Local Police and Civil administrators don’t feel threatened by the local politicians/goons. That causes less pace of work flow.
Let’s see what happens next and how much he succeeds in the makeover of UP.

Even the so called Cash rich Navratna and Miniratna companies like NTPC , SECL/CCL etc bypsss the minimum wage law by using subcontractors who ultimately hire workers on short yearly contracts to get away with these laws. This is the reason they are cash rich

New Delhi:
A day after Uttar Pradesh and Madhya Pradesh made bold labour reforms, the Gujarat government on Friday announced that it will allow new industrial units to not comply with labour laws, except three basic acts, for 1,200 days.

The state chief minister Vijay Rupani announced that his government has also decided to make the approval process for establishing new industries completely online and they will be allocated land within seven days and all necessary government approval within 15 days.

“The new industrial units will be provided with relief from all the related acts and norms for 1,200 days . However, they will be bound to follow Minimum Wages, Act, Industrial Safety Rules and The Employee Compensation Act. The CM has directed the Labour Department to create an ordinance for the same," a state government statement said.

"At present, a large number of industries and multinational from Japan, USA, Korea and other European nations are willing to shift their production from China to other countries. We have decided to coordinate with various Central ministries, including the External Affairs Ministry, and approach missions of different countries to attract such industries to Gujarat," Rupani said.

"Coming of industries here will not only strengthen the state''s industrial growth but also provide employment opportunities to people. A total of 33 thousand hectares of land is available for industrial use in Khoraj, Sanand, Dahej SEZ, Dholera SEZ and other private SEZs in Gujarat," he informed, news agency PTI reported.

"We have decided that the process of approvals for new industries that wish to establish themselves in Gujarat will be hundred per cent online. They will be allocated land within seven days and all the necessary permissions related to the same shall be provided in 15 days from their application," he added. Speaking about labour reform moves to spur economic growth in a pandemic year, he said "new industrial units will be provided with relief from all the related labour acts and norms for 1,200 days"

The statement comes a day after UP government brought in an ordinance to exempt businesses from complying with all key labour laws except three for a period of three years to boost investment and help resurrect businesses hit hard by the covid-19 pandemic. Similarly, MP government too had made sweeping amendments in major acts including Industrial Dispute Act, and Factories Act, Migrant workers and reduced the paper work for companies to help them recover faster from the Covid-19 crisis and restart their businesses.

Complete mockery and destruction of country institutions as well as democracy if there was anything left of it in first place.

This was the only line in your entire post which made me feel faint.

Out of sheer morbid interest, what exactly prompted you to vote for this government in the first place.

BTW, are we referring to the 2019 election here or the 2014 one or both.

2014 i voted for him , 2019 i did not cause i knew which way things were going and this guy and govt did not disappoint, not one bit. I hope stupid unemployed as well employed youth of this country has some braincells left in there heads. I can see and hear voices of dissent even from the usual bhakt crowd who have started to feel some heat. there is a massive danger here of country slipping into complete anarchy down the line. Message is clear, you are with us or to the gulag.
